<p>Complaints of AT&amp;amp;T throttling data for it&#8217;s heavy data usage customers is rampant on the web.  Everywhere you hear stories of customers data speeds being slowed down to unusable speeds.  Now there is a way to fight back.  I was especially fond of hearing this news.</p>

Heres Five Steps to Put The Ball Back In Your Court" />My  wife and I have had the Unlimited Data Plan since the  first  iPhone and never had a problem, until recently. I introduced  wifey to TuneIn radio, She was in love. But after a week or so, I received a  this text.</p>
<p>&#8220;<strong>ATT Free Msg: Your data use this month places you in the top 5% of users. Use Wi-Fi to help avoid reduced speeds. Visit <a href="http://www.att.com/dataplans" target="_blank">www.att.com/dataplans</a> or call 8663447584&#8243;</strong></p>
<p>I was peeved, all<strong> </strong>from Internet radio?<strong> </strong>What  is the point of unlimited if it isn&#8217;t&#8230;Unlimited!?! Yes I know, all about the fine print, but still. Then I read this  courtesy of MacTech and Southern California Attorney Bradley Sniderman.  Its some quick easy steps to filing in small claims court. I have heard of two cases being won so far, who knows, I might just give it a shot.</p>
<div><em><strong>1)  Where to file — most lawsuits, even those from small claims, need to   be filed in the jurisdiction where the defendant can be found. In this   case (and let’s use AT&amp;T), AT&amp;T may have corporate offices in   only a few locations, but since they are a nationwide phone company,   they are usually subject to jurisdiction anywhere. What this means is   that you can file your small claims suit in the courthouse most   convenient to you.</p>
<p></strong><strong> </strong><strong> </strong><strong> </strong><strong>2) Make sure you have a copy of your  contract, and please review the  entire agreement. It may be a slow  read, but you need to know the terms  of it. You may be able to use  these terms to show that AT&amp;T does not  have the right to slow your  data speed.</strong> <strong> </strong></p>
<p><strong> </strong><strong>3) You need to be able to show that you have  an unlimited data plan,  which means you are entitled to unlimited  data. You need to also show  proof that AT&amp;T had limited your data  streaming. You next have to  argue that AT&amp;T has no right to charge  you a fee for unlimited data,  and then not supply it. It is not your  fault that AT&amp;T can’t keep  up with demand for data. If you can even  show that you are using less  data that some of the fixed rate plans,  such as the 3 gigabyte plans,  that is even better (fixed plans using  more data than you use, but they  are not being throttled back). Make  sure you have been paying your bill  on time and that you are not late,  since that could be used against you.</strong> <strong> </strong></p>
<p><strong> </strong><strong>4) Make sure you  have an amount for damages. You need to show how you  were damaged by  not having data streaming. This could be by showing lost  business  opportunities or showing how much you have paid for the  service you  never got.</strong> <strong> </strong></p>
<p></em><em> </em><em> </em><em><strong> </strong></em><em><strong>5) Be polite, and make sure you are prepared.  The court will listen to  you, but if you don’t know what you are  talking about, then your  argument gets lost.</strong></em></p>

<p>O2 have recently announced that any user going abroad with their phone must disable iMessage in order to stop any data roaming charges. Turning data roaming off will not stop iMessage charges if you receive or send any iMessages whether it be to other users abroad or back to the UK. This may only apply to O2&#8217;s network so it&#8217;s always worth checking with your network to see what your data costs are in terms of iMessage.</p>

<p>You can disable iMessage in the iPhone&#8217;s settings menu (Settings -&gt; Messages) to ensure you do not receive any data charges. Make sure you disable data roaming and mobile data too! (Settings -&gt; General -&gt; Network -&gt; Data Roaming &amp; Mobile Data [Off])</p>

<p>Apple today announced that iPhone 4S, the most amazing iPhone yet,  will be available in Hong Kong, South Korea and 13 additional countries  on Friday, November 11. Customers will be able to pre-order iPhone 4S  beginning on Friday, November 4.<br />

iPhone 4S is packed with incredible new features including Apple’s  dual-core A5 chip for blazing fast performance and stunning graphics; an  all new camera with advanced optics; full 1080p HD resolution video  recording; and Siri, an intelligent assistant that helps you get things  done just by asking.</p>
<p>Beginning Friday, November 11, iPhone 4S will be available in Albania,  Armenia, Bulgaria, El Salvador, Greece, Guatemala, Hong Kong, Malta,  Montenegro, New Zealand, Panama, Poland, Portugal, Romania and South  Korea. iPhone 4S is available today in 29 countries around the world and  will be available in more than 70 countries by the end of the year.</p>
<p>iPhone 4S comes in either black or white for a suggested retail price of  $199 (US) for the 16GB model, $299 (US) for the 32GB model and $399  (US) for the new 64GB model. iPhone 4S is sold through the Apple  Online Store, Apple’s retail stores and select Apple Authorized  Resellers. iPhone 4 is available for just $99 (US) and iPhone 3GS is  available for free with a two year contract from participating carriers.</p>

<p>Apple today announced it has sold over four million of its new iPhone 4S, just three days after its launch on October 14. In addition, more than 25 million customers are already using iOS 5, the world’s most advanced mobile operating system, in the first five days of its release, and more than 20 million customers have signed up for iCloud, a breakthrough set of free cloud services that automatically and wirelessly store your content in iCloud and push it to all your devices. iPhone 4S is available today in the US, Australia, Canada, France, Germany, Japan and the UK, and will be available in 22 more countries on October 28 and more than 70 countries by the end of the year.<br />

<p>“iPhone 4S is off to a great start with more than four million sold in its first weekend—the most ever for a phone and more than double the iPhone 4 launch during its first three days,” said Philip Schiller, Apple’s senior vice president of Worldwide Product Marketing. “iPhone 4S is a hit with customers around the world, and together with iOS 5 and iCloud, is the best iPhone ever.”</p>
<p>iPhone 4S is the most amazing iPhone yet, packed with incredible new features including Apple’s dual-core A5 chip for blazing fast performance and stunning graphics; an all new camera with advanced optics; full 1080p HD resolution video recording; and Siri, an intelligent assistant that helps you get things done just by asking.</p>
<p><strong>Pricing &amp; Availability</strong><br />
iPhone 4S comes in either black or white and is available in the US for a suggested retail price of $199 (US) for the 16GB model, $299 (US) for the 32GB model and $399 (US) for the new 64GB model. iPhone 4S is available from the Apple Online Store, Apple’s retail stores and through AT&amp;T, Sprint, Verizon Wireless, and select Best Buy, Target and Walmart stores and select Apple Authorized Resellers. iPhone 4 is available for just $99 (US) and iPhone 3GS is available for free with a two year contract.</p>
<p>iPhone 4S will be available on October 28 in Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Mexico, Netherlands, Norway, Singapore, Slovakia, Slovenia, Spain, Sweden and Switzerland.</p>

It offers some substantial  upgrades from the original device, but it looks identical to the iPhone  4.  Will people look past the lack of a new design and purchase, or will  disheartened iOS users flock to Android?</p>
