Apple files for preliminary injunction against Samsung

In April Apple filed a lawsuit against Samsung for patent infringement, the Galaxy S 4G, Epic 4G, Nexus S and Galaxy Tab designs was according to Apple copied from the iPhone. Now Apple wants the US District Court for the Northern District of California to force Samsung to pull these devices from the US market.

If the court decides in Apples favour Samsung will be forced to pull the devices within months, possibly less than only two. Through if the motion fails, Apple’s lawsuit from April might be affected. It might to both the court and the rest of the world look like Apple has set it’s demands to high. A court will only grant a preliminary injunction if there is a really convincing and strong case. So even if they decide against Apple in this case the primary lawsuit might still go Apples way. To avoid having to pull it’s flagships from the US market, Samsung might settle with Apple.

We’re now waiting for Samsung to respond on Apples opening brief, and after that Apple is able to respond to that. Apple is trying to get a court hearing on 5th August, where it will formally ask the judge to order the injunction.
